Terms and Conditions
The content, merchandise, and services made available to you (customer) on this site are provided by New Existence LLC (Appleseedbabies.com) in accordance with the following terms and conditions of use and privacy policy ("Terms and Conditions"). The Terms and Conditions constitute an agreement between you and New Existence LLC (Appleseedbabies.com), in respect of your use of this site, and your use of this site is conditioned upon your acceptance of the Terms and Conditions without modification. Your use of this site constitutes your acknowledgement and acceptance of the Terms and Conditions in their entirety.
Returns, Damages, and Defects
****IMPORTANT INFORMATION****
Please make sure to sign for your order only if shipment arrives in good condition. If the package is compromised or damaged in any way do not accept delivery. If you do accept delivery, and damage to the containers or merchandise is visible, please insist that a notation be made on the bill of lading: "DAMAGED".
Please remove all packaging and examine the shipment carefully upon receipt. RETAIN ALL PACKAGING until inspection is complete and the item is confirmed to have been received in good condition (returns for damage claims or any other claims will not be considered without the original packaging).
If goods have been received damaged it is imperative to your damage claim to RETAIN ALL ORIGINAL PACKING MATERIAL. Appleseedbabies.com is not responsible for damage suffered in transit or storage.
Once your furniture purchase has shipped, all sales are final. Furniture items are nonrefundable and are not able to be exchanged. No merchandise may be returned by customer without Appleseedbabies.com's prior approval. All returns shall be subject to verification on arrival at the location specified for the return of the merchandise in such approval. If any part of the merchandise is damaged in transit or defective due to manufacturing, Appleseedbabies.com will either offer replacement parts or we will replace the entire item at no additional charge. Appleseedbabies.com, inc. has the final approval for all replacements. All defects and transit related damages need to be reported within 24 hours of delivery in order to receive replacement parts / merchandise with no additional costs. Failure to make any claim: (i) in writing; and (ii) within such period, shall constitute an irrevocable acceptance of the merchandise and an admission by the customer that the merchandise fully complies with all terms & conditions.
The foregoing constitutes customer’s sole and exclusive remedy and Appleseedbabies.com's sole obligation with respect to merchandise furnished hereunder. Appleseedbabies.com makes no other warranty or representation with respect to the merchandise, either express or implied, including without limitation, that of fitness for particular use. Appleseedbabies.com shall not be liable for direct, indirect, incidental, special or consequential damages under any circumstances, including, but not limited to, damage or loss resulting from inability to use the merchandise or any other damages.
If a package is returned to the warehouse for reasons of being non-deliverable or for customer refusal, the shipping charges for the return shipment will be charged back to the customer. Additionally, there is a return fee of $10.00 plus a charge equal to 4% of the total merchandise value to receive the goods back into the warehouse on behalf of the customer. The items that are returned are still regarded as property of the customer and can be reshipped as per the customer's request with the usual fees that apply.
For items that are defective and reported within 24 hours, in most cases, Appleseedbabies.com will have the item picked up first and Appleseedbabies.com will resend another part / unit for replacement. In the case that items need to be picked up, it is ESSENTIAL that the consignee keep all original packaging materials to repackage the unit for pick up. If the original packaging materials and carton are not available, Appleseedbabies.com cannot offer replacement parts. In some cases, Appleseedbabies.com reserves the right to request photos before issuing replacement items.
For items that are damaged in transit and reported within 24 hours, Appleseedbabies.com will file a claim with the carrier, and then carrier will pick up and inspect the items from the recipient. After the pick-up of the damaged item is confirmed, then Appleseedbabies.com will issue a replace part / piece based on availability. IMPORTANT: In order for Appleseedbabies.com to file the claim with the carrier, the consignee must be able to repackage the items with their original packaging material and in the original carton in which the items were received. If the original packaging materials, including the box, are not available, then Appleseedbabies.com cannot issue replacements free of charge. In this case, replacements can be sent only at their regular price.
If an item is damaged more than once in its attempt to reach the customer, Appleseedbabies.com will regard the area to be undeliverable by standard means or common carrier used in previous two attempts. Upon the 2nd replacement (or 3rd shipment), Appleseedbabies.com has the option to select other shipping options to guarantee safe delivery. This may increase the cost of the shipping and will be charged directly to the customer.
It should also be noted that in the pursuit to maintain a sustainable green furniture line, the wood contained in these products are harvested from sustainably managed forests. Appleseedbabies.com will not be responsible for accepting returns or exchanges for any color differences or natural variations or textures found in the wood from one piece of furniture to the next. Appleseedbabies.com will also not be responsible for accepting returns or exchanges for any color difference, or perceived color difference between items received by a customer, and those items found on our website.
Replacement parts
Unfortunately, sometimes furniture or other items are damaged when shipped to you. In the case that a defect or damage exists in only a part of the item purchased, Appleseedbabies.com reserves the right to only replace that part that is damaged. Such damages do not necessitate an entirely new shipment. For replacement parts requested, please request within 24 hours of delivery. If a part is requested after 24 hours, Appleseedbabies.com reserves the right to determine if the defective part is due to customer misuse or due to poor manufacturing or shipping damages.
Returns, Damages and Defects – Bedding, Gifts, and Toys
Any non-custom item that is unopened, in its original packaging and accompanied with a receipt of purchase may be returned within 14 days of receipt.
Opened items may be returned only if defective and are subject to a restocking fee.
PLEASE NOTE: Pillows and mattresses may not be returned once opened due to health laws unless defective. Please inspect these items carefully upon receipt. These items arrive sealed so you can see them BEFORE you open them.
Returns, Damages and Defects – Diaper Cakes
Our Diaper Cakes are handmade, custom items from scratch. Returns and exchanges are available ONLY if the diaper cake is damanged or defective upon arrival. All diaper cakes are constructed securely and inspected and so are guaranteed not to fall apart in transit. In the unlikely event that your diaper cake arrives damanged or defective, please notify Appleseedbabies.com within 48 hours of receipt for an exchange or to return it. The defective diaper cake must be returned within 5 business days of receipt and must be in original condition. There will be no returns or exchanges on any cakes that have been unwrapped, rewrapped, opened, or tampered with in any way. We reserve the right to deny the return or exchange of any diaper cake. Packages that are denied will be charged a 30% restocking fee, after shipping costs. Shipping the diaper cake back to us is the customer's responsibility.

Cancellations
In the event you need to cancel an order please send an email to support@Appleseedbabies.com prior to the actual day of shipment of the item. This way we won’t have to charge you anything to cancel prior to shipment. If you cancel the same day of shipment, and the shipment can be stopped before leaving the warehouse, there will be $10.00 cancelation fee plus an additional 10% restocking fee. If we receive a cancelation either on the same day or after the day of shipment, the shipment cannot be returned to Appleseedbabies.com (please review conditions for returns). If an order has been canceled/refused after the order has shipped, the merchandise shall beregarded as the property of the customer and cannot be returned for a refund. If it is returned to our warehouse, Appleseedbabies.com will reship the items in accordance with its normal shipping fees and Appleseedbabies.com will no longer be liable for shipping related damages.

Indemnification
You agree to indemnify and hold harmless Appleseedbabies.com, Inc. and its directors, officers, employees, contractors and suppliers ("Indemnified Parties"), from and against any and all claims, demands, actions, proceedings and damages, including without limitation reasonable attorneys' fees and costs, that may be incurred by any of the Indemnified Parties and that arises from or relates to your use of this site.
Changes to Site and Terms & Conditions
We reserve the right to change or modify all or any portion of this site, including any and all content, merchandise or services featured on this site, at any time in our sole discretion. Sales prices for merchandise and services are subject to change without notice, and if merchandise or services are listed at an incorrect sales price, we reserve the right to refuse, cancel or limit any orders placed for such merchandise or services at the correct price. We also reserve the right to change or modify all or any portion of these Terms and Conditions at any time in our sole discretion. At times such changes may be necessary to address the addition or discontinuance of merchandise or services offered on this site, technological changes made to this site, changes made to our business procedures or practices, or other factors. More importantly, we will not be obligated to notify you of these changes as and when they are made. Accordingly, it is important that you review these Terms and Conditions regularly. If you disagree with any change that we may make to these Terms and Conditions, your sole recourse is to discontinue your use of this site.
Appleseedbabies.com Limited Warranty
Most Appleseedbabies.com products are covered by a manufacturer’s one year Limited Warranty against defective materials or workmanship. This warranty is non- transferable from the original owner to any other subsequent purchaser, and it is effective from the purchase date. The manufacturer’s limited warranty covers only damage that is a direct result of the manufacturing process or defective materials. Neither Appleseedbabies.com nor the manufacturers will be responsible for any damage caused by negligence, misuse, incorrect installation, customer modifications, improper storage or improper maintenance. The Warranty does not apply if product damage results from the use of detergents, cleansers, abrasives or other harsh cleaning agents. The customer's use and expectations of these products should not exceed the testing procedures, safety guidelines, and voluntary standards set forth by the ASTM. The warranty will not apply if modifications or repairs are done by the purchaser or a third party repair service without manufacturer’s prior approval. The warranty will not apply if upon discovery of a defect the customer fails to take prompt and reasonable steps to prevent the defect from becoming more serious. Wood characteristics are not covered by this Limited Warranty. Some toppers and mattress pads have an additional one year Limited Warranty.
